Collection agencies have obstacles

Most consumers do not realize that collection agencies are so overburdened with collection efforts that they are consistently violating consumer protection laws such as the Credit Reporting Agencies Act and the Fair Debt Collection Practices Act. Credit laws may look a little tricky at first, but fortunately the laws are in the consumers favor.

One obstacle that collection agencies have is that when you request that the collection agency verify a debt they must comply. If the collection agency does not comply, they must remove the collection from your credit report. The collection agencies have 30 days to respond to the request for verification. This time restriction puts extra strain on the collection agency by tying up their resources. The only document that can verify that the debt is valid, is the original contract. A copy of the contract, with your signature showing that you agreed to the debt is the only document that can verify your debt. The collection agency must reach out to the original creditor and ask for the contract with your signature.

Time Constraints

This process takes time and sometimes CAN’T be completed in the 30 days that the collection agency has. The original bank also has to tie up resources to retrieve and deliver a copy of the signed document. Remember, the original bank or creditor already sold the debt to the collection agency. When the bank sells the debt they no longer have a vested interest in collecting the debt. At this point the original bank or creditor may neglect to send the original contract since this process is costly. Banks do not want to incur costs when they have no further upside if the debt is paid.

Small Collections

Sometimes, if the collection is small, the collection agencies will not devote resources to verifying the accuracy and validity. When the collection agency neglects the verification process, the debt is considered unverifiable. All unverifiable debts must be removed from your credit history.
